Terms of Service

1. Acceptance of Terms

By accessing and using Nikahly, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use Licence

Permission is granted to temporarily use Nikahly for personal, non-commercial wedding planning purposes. This is the grant of a licence, not a transfer of title.

Under this licence you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose
• Attempt to decompile or reverse engineer any software contained on Nikahly
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or mirror the materials on any other server

3. Liability Disclaimer

Nikahly acts solely as a marketplace connecting couples with wedding vendors. We do not employ, recommend, or endorse any vendors. All agreements, payments, and services are directly between you and the vendor.

4. User Content

You retain all rights to photos, text, and other content you upload to Nikahly. By uploading content, you grant Nikahly a non-exclusive licence to store, display, and process your content solely for the purpose of providing our services.

You are responsible for ensuring you have the right to upload any content and that it does not violate any third-party rights or applicable laws.

5. Payment Terms

All prices are displayed in British Pounds (£). The Nikahly Forever package is a one-time payment of £49 that provides lifetime access to all wedding planning features including digital invitations, RSVP management, guest lists, and gift registries.

Refunds are handled on a case-by-case basis within 14 days of purchase. Please contact support for refund requests.

6. Storage & Data Retention

6.1 Storage Renewal

Upon the first anniversary of your purchase, a storage hosting fee is required to maintain high-resolution cloud hosting access. Current rates are:

• Monthly: £1.99 per month
• Yearly: £19.99 per year (save approximately 15%)

Your wedding app features (invitations, RSVP, guest management, registry) remain accessible forever, regardless of storage renewal status.

6.2 Non-Payment Policy

If the storage subscription is not renewed after the initial 12-month period:

• Access to high-resolution files will be restricted
• Your photos will remain in a "Frozen" state with view-only or low-resolution access
• A grace period of 90 days will be provided to download your data or renew your subscription
• After the 90-day grace period, if no action is taken, data may be permanently deleted from our servers
• You will receive email notifications at 30, 60, and 75 days during the grace period

6.3 Price Guarantee

The storage hosting fee is fixed at the current rate for the first 5 years from your initial purchase date. After this 5-year period, Nikahly reserves the right to adjust pricing in line with inflation and server costs. You will be notified of any price changes at least 60 days in advance.

6.4 Data Ownership & Portability

You retain full ownership and intellectual property rights to all media you upload. You may download your high-resolution photos and videos at any time while your storage subscription is active. We recommend maintaining your own backup copies of important files.

6.5 Data Security

Your wedding data and photos are stored securely using enterprise-grade cloud infrastructure with encryption both in transit and at rest. We maintain regular backups to protect against data loss. Storage limits apply based on your plan, and you will be notified before storage limits are reached.

7. Free Account Inactivity Policy

7.1 What Constitutes Activity

Activity includes but is not limited to:

• Logging into your account
• Viewing or editing your wedding invitation
• Managing guests or RSVPs
• Uploading photos or content
• Making any changes to your wedding settings

7.2 Exemption for Premium Users

Users who purchase the Nikahly Forever package are exempt from this inactivity policy. Premium accounts remain active indefinitely regardless of login frequency, though storage subscription terms still apply as outlined in Section 6.

7.3 Notification Process

We will send email notifications to free accounts as follows:

• At 20 days of inactivity: First reminder email
• At 27 days of inactivity: Final warning email
• At 30 days of inactivity: Account deletion confirmation email

Simply logging in at any point before the 30-day mark will reset the inactivity counter.

7.4 Data Recovery

Once a free account is deleted after 30 days of inactivity, all data is permanently removed from our servers and cannot be recovered. We strongly recommend either maintaining regular activity or upgrading to the Nikahly Forever package to preserve your wedding planning data.

8. Account Termination

We reserve the right to terminate or suspend accounts that violate these terms or engage in abusive, fraudulent, or illegal activity.

You may close your account at any time. Upon closure, you will have 30 days to download your data before permanent deletion.

9. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of Nikahly after changes constitutes acceptance of the modified terms. Significant changes will be communicated via email.
